Effective and last updated: September 4, 2026
1. Agreement and operator
These Terms of Use govern your access to and use of the JoyZap websites, applications, and related services (together, the Service). The Service is operated by Joy Company LTD, Varna, Bulgaria (JoyZap, we, us, or our). You can contact us at contact@joyzap.net.
By creating an account, accessing the Service, purchasing Joy Dollars, or sending a paid Public Zap, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. Additional terms shown for a particular feature or purchase also apply to that feature or purchase.
2. Eligibility and age requirement
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, purchase Joy Dollars, or send a paid Public Zap. JoyZap is not directed to children. By using one of these features, you confirm that you meet this requirement.
You may use the Service only where it is lawful and available. We may refuse registration, restrict a payment, or suspend access when reasonably necessary to verify eligibility, comply with law, protect users, or prevent fraud.
3. Accounts and security
You must provide accurate, current information and keep it up to date. You are responsible for protecting your password and devices and for activity performed through your account. Tell us promptly at contact@joyzap.net if you suspect unauthorized access.
You may not create an account for another person without authority, impersonate another person or organization, sell or transfer an account, or use another person's credentials. We may require reasonable verification before changing sensitive account details or providing account support.
4. The JoyZap Service and Public Zaps
JoyZap is a social celebration and digital-gifting service. Features may include public or private profiles, events, follows, reactions, rankings, Joy Battles, catalog presents, cards, media messages, mystery gifts, and time capsules. Feature availability can depend on location, device, recipient settings, catalog availability, and account status.
A Public Zap allows an adult guest to use Stripe Checkout to purchase and send a specific catalog present to the owner of a public JoyZap event. A Public Zap does not create a guest Joy Dollar wallet, does not transfer money to the recipient, and may be unavailable if the event or recipient is unavailable before delivery.
Public pages and shared gift links may be viewed without an account. Do not submit personal information or content that you do not have the right to share publicly or with the intended recipient.
5. Joy, Joy Sent, and Joy Dollars
Joy Dollars (JD) are a closed-loop, spendable balance used for eligible digital gifts and features inside JoyZap. The number of JD required is shown before confirmation. A scheduling premium may increase the JD cost of delayed delivery without increasing the base gift value.
Joy Received reflects base value associated with eligible gifts a user receives. Joy Sent reflects base value associated with eligible gifts a user sends. They are permanent, non-spendable reputation measures used for profile totals and rankings.
Joy Dollars have no cash value outside JoyZap and do not earn interest. They cannot be cashed out, transferred out, redeemed, or withdrawn. Joy Received and Joy Sent are reputation measures and cannot be spent or exchanged for money. None of these resources is a deposit, investment, bank account, electronic-money account, or claim to a payout from JoyZap.
6. Digital gifts, scheduling, and delivery
Catalog presents are digital items selected from JoyZap's current catalog. Cards, media gifts, messages, and time capsules may include content supplied by the sender. Unless expressly stated otherwise, these are digital experiences and do not represent delivery of physical goods or money.
Immediate gifts are processed after confirmation. Scheduled gifts and time capsules use the selected delivery time and remain subject to recipient availability and technical processing. Timing may be affected by network, platform, time-zone, moderation, safety, or legal requirements.
If you address a gift using an email address or phone number, you confirm that you may use that contact detail for the intended delivery. You are responsible for checking the destination. We may prevent, revoke, delay, or cancel delivery to protect a person, comply with law, correct an error, or enforce these Terms.
7. Prices, payments, cancellation, and refunds
Prices and applicable currency are displayed before purchase. Payments are processed by Stripe and may also be subject to Stripe's terms and privacy practices. You authorize the displayed charge and must use a payment method you are permitted to use. JoyZap does not receive or store your full payment card number.
Digital content or performance may begin immediately when you request a purchase or delivery. Where applicable law gives you a withdrawal period, you lose that right before the period ends only when the legal conditions for immediate performance, express consent, and acknowledgement are satisfied.
Except where mandatory consumer law requires otherwise, a refund is not due merely because a recipient does not react to, like, or use a delivered digital gift. We may issue or require a refund, replacement, or Joy Dollar restoration for duplicate charges, failed delivery, unavailable recipients, security incidents, or other circumstances described in the purchase flow or required by law.
Contact us promptly about a payment problem before initiating a chargeback where practical. Nothing in these Terms excludes a refund, remedy, cancellation right, liability, jurisdiction, or other protection that applicable consumer law does not permit us to exclude. You remain responsible for taxes that law places on you; JoyZap remains responsible for taxes that law places on JoyZap.
8. Your content and permissions
You retain ownership of content you create or upload. You confirm that you own the content or have all permissions needed to submit it, including permissions from identifiable people and rights in music, images, video, text, links, trademarks, and other protected material.
You grant JoyZap a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for technical formats, transmit, display, and otherwise process your content only as reasonably necessary to operate, secure, improve, and provide the Service according to your actions and settings. This licence ends when the content is deleted, except for copies already delivered to another user, limited backups, or records we must retain by law or for legal claims.
The operational licence does not give JoyZap an unrestricted right to use private content in advertising. We will obtain a separate lawful basis or permission where one is required for marketing use.
9. Acceptable use
You must use JoyZap lawfully and respectfully. You must not use the Service to create, upload, send, promote, solicit, or link to:
- child sexual abuse or exploitation, grooming, sexualization of minors, or child sexual abuse material (CSAM);
- threats, harassment, stalking, non-consensual intimate material, hateful conduct, graphic violence, or content encouraging self-harm;
- fraud, money laundering, sanctions evasion, terrorism, trafficking, illegal drugs or weapons, or another unlawful activity;
- malware, credential theft, unauthorized access, interference with the Service, automated scraping, spam, or attempts to bypass safety, payment, or access controls;
- impersonation, deceptive claims, intellectual-property infringement, privacy violations, or disclosure of another person's confidential information; or
- transactions intended to manufacture Joy, rankings, referrals, or other platform signals rather than send a genuine digital gift.
Our Child Safety Standards apply to every account and feature. If you see suspected CSAM, do not download, save, forward, or reshare it; use the in-app reporting tools or contact us immediately.
10. Reports, moderation, and enforcement
Users can report certain events, gifts, profiles, and battle content. We may review available information and, where reasonably necessary, limit visibility, remove content, stop delivery, restrict features, preserve evidence, warn a user, suspend or terminate an account, or refer a matter to a competent authority.
We consider the nature, context, severity, frequency, and legal requirements of a case. Automated signals may assist review but do not guarantee a particular outcome. Contact us if you believe an enforcement decision affecting you is mistaken. We may not be able to disclose information that would compromise another person's rights, security, or an investigation.
11. JoyZap intellectual property
The Service, software, visual design, JoyZap name and logos, catalog presentation, and content supplied by JoyZap or its licensors are protected by intellectual-property laws. Subject to these Terms, JoyZap grants you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose.
You may not copy, modify, sell, reverse engineer, extract, sublicense, or commercially exploit protected parts of the Service except where applicable law expressly permits it. To report a rights concern, provide enough information for us to identify the protected work, the disputed material, and your authority to act.
12. Third-party services and content
JoyZap relies on third-party infrastructure and services, including payment, hosting, email, social sign-in, push notification, location, and linked-content providers. Their separate terms and privacy notices may apply when you interact with them. JoyZap is responsible for its own obligations but does not control an independent third party's systems or content.
Links and previews do not imply endorsement. You are responsible for deciding whether to visit or share third-party material and must not use a link to evade these Terms.
13. Changes and availability of the Service
We aim to provide a reliable Service but do not guarantee uninterrupted, error-free, or permanent availability. Maintenance, security, legal requirements, third-party outages, product changes, and events outside reasonable control may interrupt or change features.
We may add, modify, limit, or discontinue features. Where a change materially and adversely affects a paid consumer service, we will provide notice and remedies required by applicable law.
14. Disclaimers and limitation of liability
To the extent permitted by law, the Service is provided on an as-is and as-available basis. We do not promise that another user will respond to a gift, that user content is accurate, or that every third-party service will remain available.
JoyZap does not exclude or limit liability where doing so would be unlawful, including liability for fraud, intentional misconduct, gross negligence where it cannot be excluded, death or personal injury caused by negligence, or mandatory consumer rights. Otherwise, to the maximum extent permitted by law, JoyZap is not liable for indirect or unforeseeable loss, loss caused by your breach, or loss arising solely from an independent third party outside our reasonable control.
Nothing in this section limits your obligation to take reasonable steps to protect your account or our obligation to apply legally required security and consumer protections.
15. Your responsibility
You are responsible for your content, your choice of recipient, and your breach of these Terms or another person's rights. To the extent permitted by applicable law, you will reimburse JoyZap for direct, reasonable losses finally awarded or agreed as a result of your unlawful content, fraud, or material breach. This does not apply to losses caused by JoyZap or remove rights you have as a consumer.
16. Suspension, termination, and account deletion
You may stop using JoyZap and may request account deletion through the in-app flow or the public Delete Account page. Deletion permanently ends access to the account. Any unused Joy Dollar balance becomes unavailable and may be forfeited, subject always to a refund or remedy that mandatory law requires.
Pending gifts may be cancelled when a sender or recipient account is deleted. Where the implemented flow restores a debited Joy Dollar cost for an undelivered gift, that restoration is an internal-balance correction, not a cash payout or automatic reversal of the original Stripe purchase.
We may suspend or terminate access for a serious or repeated breach, fraud, security risk, recipient protection, legal requirement, or material harm to the Service. Where appropriate and lawful, we will explain the decision and provide a way to contact us. Provisions that by their nature must survive termination, including intellectual property, payment records, disputes, and lawful retention, remain effective.
17. Changes to these Terms
We may update these Terms to reflect product, legal, security, or operational changes. We will post the updated version and its effective date. For material changes, we will provide reasonable advance notice through the Service or available contact details when required. Changes do not retroactively remove rights that have already arisen.
If you do not accept an updated version, you must stop using the affected Service and may request account deletion. Continued use after the effective date constitutes acceptance only to the extent permitted by law.
18. Governing law, disputes, and contact
These Terms are governed by Bulgarian law, without prejudice to mandatory protections provided by the law of your country of residence. Courts in Bulgaria have jurisdiction except where mandatory consumer or procedural law allows or requires you to bring a claim in another competent court.
Before bringing a formal claim, you may contact us at contact@joyzap.net so we can try to resolve the concern. This informal step does not shorten a statutory limitation period or prevent either party from seeking urgent relief or using a competent consumer or regulatory body.
If a provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision once is not a waiver. These Terms, the Privacy Policy, and feature-specific terms form the agreement about the Service and do not create an employment, agency, partnership, or fiduciary relationship.
